Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Sebastian Group website (the “Site”), operated by Sebastian Group LLC (“Sebastian Group LLC,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.

The Site provides information about Sebastian Group LLC’s executive search, go-to-market consulting, and pipeline engineering services (the “Services”) and allows visitors to submit inquiries, candidate materials, or requests for consultation. Use of the Site, including submission of a form or resume, does not by itself create a client relationship, candidate representation relationship, engagement, or any other contractual obligation between you and Sebastian Group LLC. Any such relationship arises only through a separate signed agreement.

The Site is intended for business and professional use. By using the Site, you represent that you are at least 18 years old and have the authority to provide any information you submit, including on behalf of an organization you represent.

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Submit false, misleading, or fraudulent information, including in a candidate submission;
• Attempt to gain unauthorized access to the Site, its systems, or related networks;
• Interfere with or disrupt the operation of the Site, including through malware, scraping, or excessive automated requests;
• Copy, reproduce, or exploit any content on the Site beyond what is permitted in Section 5; or
• Use the Site to infringe the intellectual property, privacy, or other rights of any third party.

All content on the Site, including text, graphics, logos, and the “Sebastian Group LLC” name and marks, is owned by Sebastian Group LLC or its licensors and is protected by intellectual property laws. You may view and print Site content for your own personal, non-commercial, informational use. No other use, including reproduction, distribution, modification, or creation of derivative works, is permitted without our prior written consent.

If you submit a resume, candidate profile, business information, or other materials through the Site (“Submissions”), you represent that you have the right to share that information and that it is accurate. Submitting materials does not guarantee any placement, engagement, response, or outcome. We handle Submissions in accordance with our Privacy Policy. Submitting a Submission does not, by itself, create any duty of confidentiality beyond what is described in our Privacy Policy or a separate signed agreement.

The Site may contain links to third-party websites that are not owned or controlled by Sebastian Group LLC. We are not responsible for the content, privacy practices, or terms of any third-party site, and inclusion of a link does not imply endorsement.

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. NOTHING ON THE SITE CONSTITUTES A GUARANTEE OF EMPLOYMENT, PLACEMENT, ENGAGEMENT, OR ANY PARTICULAR BUSINESS OUTCOME.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SEBASTIAN GROUP LLC, ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY ARISING OUT OF YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

You agree to indemnify and hold harmless Sebastian Group LLC and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of your use of the Site or your violation of these Terms.

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Illinois, and you consent to the personal jurisdiction of those courts.

We may revise these Terms at any time by posting an updated version on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
